Representing clients in jury trials before the United States District Court and bench trials in the United States Tax Court, the firm has been successful in obtaining favorable results for our clients, including recovery of attorney fees from the government.
Several recent decisions of note include: McNamara v. Comm., 87 A.F.T.R.2d 2001-310 (8th Cir. 2000) (cash rent to active farmers not necessarily subject to SE tax); NDSU v. U.S. 87 A.F.T.R.. 2d 2001-2552 (8th Cir. 2001) (tenure buyouts not payment of wages subject to withholding taxes); H.B. & R., Inc. v. U.S., 86 A.F.T.R.. 2d 2000-6426 (8th Cir. 2000) (air transportation of employees was a necessary business expense not subject to withholding taxes.)
